This Limited Warranty (“Warranty”) is issued by 3H Paving (“Contractor”) to the original purchaser (“Owner”) of asphalt paving services. This Warranty outlines the terms, coverage, and exclusions for workmanship and materials provided by Contractor.


1. Definitions

- Workmanship – the quality and skill with which the asphalt was installed.

- Materials – the asphalt mix, binders, and other products supplied by Contractor.

- Defect – a flaw in workmanship or materials that results in premature failure under normal use and maintenance.


2. Warranty Coverage

When all Contractor recommendations for base preparation, drainage, and maintenance are followed, the installation is warranted against defects in workmanship and materials for the following periods:

- Standard Package: 3 years

- Enhanced Package: 4 years

- Signature Package: 5 years

Coverage begins on the date of project completion.


3. Limitations on Coverage

- Damage caused by traffic loads exceeding residential or specified design limits.

- Damage from snow removal equipment (particularly steel blades), tire chains, or aggressive snow-melt chemicals.

- Damage from standing water, flooding, or drainage issues caused by insufficient slope or grade not installed by Contractor. A minimum slope of 2% throughout the project area is required to guarantee proper drainage and prevent premature damage.

- Steep sections: Any portion of a driveway with a slope greater than 15% will receive slope-related coverage only when constructed with the Contractor’s recommended slope-specific upgrades (e.g., increased asphalt thickness, premium mix designs, chip seal or traction treatments). Without such upgrades, warranty excludes slope-related wear such as slippage, raveling, or cracking for that section. All other portions of the project remain covered per standard terms.

- Damage from tree roots, settlement of subgrade, or acts of nature (e.g., earthquakes, frost heave).

- Damage from oil, fuel, solvents, or other chemicals.

- Any damage resulting from improper grading/compaction that was not performed by the Contractor.


4. Owner Responsibilities

- Follow Contractor’s written base preparation requirements before installation.

- Perform routine maintenance including sealing cracks and joints promptly.

- Avoid the use of prohibited equipment or chemicals on the surface.

- Keep surface free of standing water whenever possible.

- Do not place trailer jacks, stabilizers, or similar point loads directly on asphalt; use wood or metal plates to distribute weight.


5. Warranty Claim Procedure

All claims must be submitted in writing to Contractor within the coverage period. Contractor will inspect the pavement within 30 days of notice. If a defect covered by this Warranty is found, Contractor will, at its discretion, repair or replace the affected area.


6. Transferability

This Warranty is transferable to a subsequent property owner only with written approval from Contractor within 30 days of property transfer.


7. Limitation of Liability

This Warranty is the sole and exclusive remedy for defects in workmanship or materials. Contractor’s total liability under this Warranty is limited to the original contract price of the installation. No other warranties, expressed or implied, are given


8. Normal Wear and Tear (Not Covered)

New asphalt surfaces will experience natural changes and cosmetic wear over time that are not considered defects.

Examples include:

- Minor scuffing or tire marks from turning vehicles, especially in hot weather.

- Slight surface texture variations from paving or rolling operations.

- Minor hairline surface cracks caused by normal curing and seasonal temperature changes.

- Color fading from deep black to charcoal gray as the asphalt oxidizes in sunlight.
